Terms of sale
The summary below describes the terms on which KB NOWSALE LIMITED supplies office furniture and workplace equipment. The terms stated in your order acknowledgement take precedence.
1. Quotations and orders
Indicative prices shown on this website are in euros (EUR), exclude VAT, delivery and installation unless stated, and do not constitute an offer. A contract is formed only when we issue a written order acknowledgement.
Quotations are valid for 30 days unless stated otherwise. Trade pricing for quantities and multi-site roll-outs is confirmed in writing.
2. Prices and payment
Prices are confirmed in the order acknowledgement and may be adjusted for material or freight cost changes notified before production release.
Standard terms are 50% with order and the balance before dispatch, unless credit terms have been agreed in writing. Payment is by bank transfer; any charges are borne by the buyer.
3. Delivery and installation
Delivery dates are given in good faith and confirmed at order acknowledgement. Where access, lift availability or site readiness prevents delivery, reasonable additional costs may be chargeable.
Delivery basis (EXW, DAP or DDP) is stated in the quotation. Installation services are supplied to an agreed programme and require a clear, weather-tight and power-enabled site.
4. Inspection and claims
Goods must be inspected on delivery. Shortages, transit damage or incorrect items must be notified within five working days with photographs, so we can remedy them promptly.
Installation snagging is recorded and closed out as part of the handover process.
5. Warranty
Desks, storage and workstation systems carry a ten-year structural warranty. Mechanisms, gas lifts and upholstery carry five years. Electrical components carry three years.
Warranty covers manufacturing defect in normal commercial use and excludes fair wear, misuse, modification or damage caused by third parties. Remedies are repair, replacement of parts, or replacement of the item at our option.
6. Returns and cancellation
Catalogue items may be returned in original packaging within 14 days of delivery for a restocking charge, provided they are unused and carriage is prepaid. Bespoke, made-to-order and upholstered items cannot be returned.
Business-to-business cancellations after production release may be charged at the value of work completed.
7. Liability
Nothing in these terms excludes liability for death or personal injury caused by negligence, or for fraud. Otherwise our liability is limited to the value of the goods supplied.
We are not liable for indirect or consequential loss, including loss of profit, business or opportunity.
8. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
